REQUEST FOR EXPRESSION OF INTEREST (EOI) FOR THE PREPARATION OF AN RESETTLEMENT ACTION PLAN (RAP_ FOR AGULU-NANKA-OKO EROSION SITE

This request for expression of interest follows the update of the general procurement notice for this project that appeared in UN Development Business issue on 27th April 2012 and in Nigerian Newspapers of 27th September 2012.
As part of Government’s commitment to transformation of the Nigerian socio-economy landscape a multi-sector project is being executed in Nigeria to mitigate the vulnerability to erosion and support the people as they relate to their land. The Nigerian Erosion and Watershed Management Project (NEWMAP) is an 8-years multi-sectored and multi-scale program that targets states with acute gully erosion. The project is involving many Federal and State Ministries, Departments and Agencies (MDAS), Local Governments, Communities and Civil Societies who are responsible for Planning, economy, finance, works, Agriculture, water resources, forests, transport, power, emergency response as well as those focused on climate and hydrological information or watershed/basin regulation. In order to achieve this, the Federal Government of Nigeria (FGN) has received a credit of US$500 million from the International Development Association (IDA) for the implementation of Nigeria Erosion and Watershed Management Project.
Anambra State who is participating in the implementation of the project intends to use part of the proceeds of the credit for the preparation of a Resettlement Action Plan (RAP).
OBJECTIVE AND SCOPE OF CONSULTING SERVICE
The objective of the consulting services is to prepare a Resettlement Action Plan (RAP) for Agulu-Nanka-Oko gully erosion site in Anambra State that complies with the safeguards policies of the World Bank. As part project will involve civil works that is rehabilitation and control of Agulu-Nanka-Oko Gully Erosion site, thus triggering the Bank Safeguard Policies including involuntary Resettlement (OP 4.12).
Each RAP study is site-specific where the consulting firm will visit the full sub-watershed as delimited in the given gully stabilization design. These sub-watersheds are an average of four square kilometers in southern Nigeria. The consulting firm will take into account the proposed civil works and how it affects the target population as per World Bank guidelines.
GENERAL OBJECTIVES
Objectives of this Resettlement Action Plan include the following but not limited to:
- Establish the resettlement and compensation principles and implementation arrangements;
- Describe the legal and institutional framework underlying Nigerian approaches for resettlement, compensation and rehabilitation;
- Define the eligibility criteria for identification of project affected persons (PAPs) and entitlements;
- Establish rates for compensation on loss of assets and the methodology of determining the values;
- Define clearly the project affected persons, their eligibility for compensation, the assets to be compensated for and the cut-off date for eligibility;
- Provide a socio-economic basis for identification of entitlements and strategies for minimizing the impacts on the project affected persons;
- Describe the consultation procedures and participatory approaches involving PAPs and other key stakeholders;
- Establish land acquisition and compensation process and establish a dispute resolution mechanism to address any grievances arising from the displacement;
- Provide procedures for filing grievances and resolving disputes;
- Provide arrangements for monitoring and evaluation.
SCOPE OF WORK
The scope of the Resettlement Action Plan must ensure that the integrated social safeguards guideline of the World Bank on Involuntary Resettlement is adhered to. Therefore, the general scope of the project shall include but not limited to:
- Review relevant Nigerian law and procedures regarding land-taking and compensation as well as resettlement.
- Undertake a reconnaissance field survey in the proposed project area
- Identify the likely Project Affected Persons (PAPs)
- Consult with appropriate MDAs. Lands and Urban Development, Environment, Works, Local Government Authorities, etc.
- Consult with persons to be potentially affected by sub-project works
- Inventory of affected assets
- Costing of inventoried assets/properties.
The consulting firm will work in closely with the Anambra NEWMAP State Project Safeguard Officers, Engineering Design Consultants and other actors as directed by the State Project Management Unit (SPMU). In that respect, the sequencing of the technical/feasibility studies and the RAP will be critical. The consulting firm will have to receive the draft technical/feasibility studies to determine how the intervention will impact the Socio-Economic activities of human residents of the impacted areas.
TASK OF THE CONSULTING FIRM INCLUDE THE FOLLOWING
- Describe the existing status of the sub-watershed and gullies;
- Identify the environmental and social issues/risks associated with the existing conditions;
- Selected and measure appreciate baseline indicators (for example, m3/sec of runoff collected in the sub-watershed during a heavy rainfall);
- Develop a plan for mitigating environmental and social risks associated with construction and operation in the gully in consultation with the relevant public and government agencies;
Identify feasible and cost-effective measures that may reduce potentially significant adverse environmental and social impacts to acceptable levels;
- Develop a time-bound plan for mitigating environmental and social risks associated with sub-watershed management in consultation with the relevant public and government agencies;

- Identify monitoring objectives and specifies the type of monitoring, with linkages to the impacts assessed and mitigation measures describes above (in a-e);
- Provide specific descriptions of institution arrangements: The agencies responsible for carrying out the mitigation and monitoring measures (e.g. for operation, supervision, enforcement, monitoring and implementation, remedial action, financing reporting, and staff training) and the
Contractual arrangements for assuring the performance of each implementing agency;
- Define technical assistance programs that could strengthen environmental management capability in the agencies responsible for implementation;
- Provide an implementation schedule for measures that must be carried out as part of the project showing phasing and coordination with overall project implementation plans; and
- Provide the expected capital and recurrent cost estimates and sources of the funds for implementing the RAP and inform accordingly the design consultants so that these costs are duly taken into consideration in the designs.
SUBMISSION OF EXPRESSION OF INTEREST (EOI)
The Anambra State Nigeria Erosion and Watershed Management Project now invite eligible Consulting Firms (“Consultants”) to indicate their interest in providing the Services in each Lot. Interested consulting firms should submit their firm’s profile detailing relevant experience of RAP study(ies) carried out in the last Ten (10) years similar in scope to the proposed assignment providing letter(s) of award and completion and other supporting documents. The qualifying criteria are:
- Evidence showing that the firm is a legal entity.
- General experience of the firm’s in consulting services related to Resettlement Action for a large project in the last five (5) years;
- Demonstrate proficiency in the preparation and review of Resettlement Action Plan to meet World Bank standards;
- Demonstrate experience in Nigeria or a developing country under similar conditions;
- Availability of key staff with requisite qualifications in the field of assignment;
- The consulting firm should have proven capacity to review technical design for construction/rehabilitation works;
- Interested consulting firms must indicate their independence from any firm connected with the design of the erosion control solution for this site.
For each previous project performed, the consulting firm shall provide the name and contact address of the client (contact person, physical address, e-mail, telephone number(s), date(s) of execution, contact amount and financing sources. (viii) Description (not more than 2 pages) of the proposed Methodology for carrying out the scope of the work.

A Consultant will be selected in accordance with the Consultancy Qualification Selection (CQS) method set out in the World Bank Consultant Guidelines.
