INVITATION TO TENDER FOR PRE-QUALIFICATION FOR HIGHWAY CONSTRUCTION OF ROAD, BRIDGE AND OTHER PROJECTS
1.0               INTRODUCTION
The Federal Minisryof Power, works and Housing (Workers Sector) intends to execute some capital projects as provided for in the appropriation act 2017 and in accordance with the provisions of the public procurement act 2007. The ministry therefore invites interested and competent construction companies, civil engineering firms, etc to submit prequalification document for thee execution of the projects as listed and described in the table below.
2.0              The project which are for construction or rehabilitation are listed under categories a sand c. Bidders are therefore, requested to submit their respective bids for the categories chosen on the basic of the specific requirement of each of the categories as specified in section 4.0 of this publication as well as a realistic self-assessment of the bidders capacity and competence:

1Construction /Rehabilitation Of Other Roads, Bridge And Various States Of The Federation
3.0       Eligibility Requirements
Interested and competent contractor wishing to participate in the prequalification exercise in any of the project listed to respond to this advert based on the following requirements:
3.1 Mandatory Requirements: Non fulfillment of any of the under listed requirements will automatically render a bid disqualified:
  1. Evidence of registrations with Corporate Affairs Commission (CAC);
  2. Evidence of Tax Clearance Certificate (TCC) for the last three (3) years (2014, 2015, 2016) by inclusion of 2017 Tax Clearance Certificate;
  3. Evidence of Pension and Social Security’s contribution by inclusion of 2017 Pension Clearance Certificate;
  4. Evidence of contribution to Industrial Training fund (ITF) by inclusive of 2017 ITF Compliance Certificate;
  5. Evidence of registration on the BPP’s National Database of Federal Contractors, Consultant and Service provider by submission of current Interim Registration report (IRR);
  6. Evidence of current certificate of compliance with the Employers Compensation Act which requires all that employee of labour must remit 1% of the total annual emolument of their workers to the Nigerian Social Insurance Trust Fund (NSITF);
  7. A sworn affidavit that no partner/director has been convicted in any country for criminal offences related to fraudulent or corrupt practices, or criminal misrepresentation or falsification of facts relating to any matter and that all the require document are both Genuine And Up To Date; and
  8. A sworn affidavit disclosing whether or not any officer of FMPW&H or BPP is a former or a present director, shareholder or has any pecuniary interest in the bidder and confirm that all information presented in its bid are true and correct in all materials particular
3.2   Evaluation/ Scoring Requirement: bids that fulfill all of the requirement in 3.1 above, shall further be subject to technical evaluation based on the requirements listed in 3.2 to 4(i-iii) and only bids  that were adjudged to be technical competent and met the minimum qualifying score will be qualified for participation in the financial tender stage:
  1. Unabridged company audited annual report for the immediate past three (3) years (2014, 2015 & 2016)
  2. A statement indicating that the company does not at the time of this bid have any exiting loan or financial liability with a bank, other financial institutions or third party that is classified as doubtful, non-performance, bad or whose repayment portion has been outstanding for the last three months;
  3. Evidence of company annual returns to CAC for the immediate past three (3) years (2014, 2015 & 2016); and
  4. Evidence of particulars of directors; and
  5. Nigerian Content
Nigerian Content (NC) is “the quantum of composite value added to or created in Nigerian economy by a systematic development of capacity and capability and capabilities through deliberate utilization of Nigerian construction industry-skilled and unskilled”. Bidders shall consider Nigerian content as an important element of their overall approach and management philosophy for project execution.
Thus, in res-pounding to this invitation, bidders are required to clearly:
  • Submit a plan on how they intend to give first consideration to service provider from within Nigeria, raw materials and manufactured goods of Nigerian origin in line with the requirements of NC;
  • Submit verifiable key management positions that are Nigerian nationals and the percentage of the company’s total workforce that will be beneficial to youth employment and community development in Nigerian;
  • Indicate the quantum of verifiable employment too be generated stating projected numbers and specialties for skilled manpower and unskilled labour; and
  • All bidders should include description of current health, safety and environment (HSE) procedures, plans, manuals, and HSE performance statistic over the last 3 years including HSE manuals and accident statistic for the past five (5) years.
4.0    Specific requirements:
  1. I) for construction/ rehabilitation of road/ bridge / various projects:
Category A: roads
  1. Annual turnover
Bidders must have average annual turnover of ten (10) billion naira (as stated in a verifiable tax clearance certificate) in the last there (3) years (2014, 2015 & 2016);
  1. Bidders experience
Bidder must be a prime contractor on at least two (2) projects of similar nature, magnitude and complexity comparable to the works under consideration within the last five (5) years (copies of letter of award/certificates of completion to be attached);
  1. Number of project at hand and progress achieved on each project;
  2. Plant and Equipment
Verifiable evidence that the nature and complexity including asphalt and quarry plants in the geopolitical zone of the project bided for .Bidders for the access road phase 2A & 2B to the second Niger Bridge linking Asaba and Onitsha in Delta/Anambra State must have relevant Construction Equipment to handle Polymer Modified Bitumen Construction and must have evidence of its use in the last three (3) years in Nigeria.

  1. Financial Capacity
Evidence of access to or availability of credit facilities, confirmed by a reputable bank, equivalent of one (1) billion Naira minimum amounts of Liquid Assets nets of other contractual commitments of the successful bidder shall be required;
  1. Manpower
Company profile with CVS of key personals including photocopies of relevant academic and professional qualifications with attestation of availability and contact phone number (evidence of registration with relevant regulatory professional bodies e.g. COREN, ARCON, CORBON, QSRBN); and
  1. Maximum number of lots
Bidders must restrict their submission of bids to a maximum of one(1) lot, in this category, located in a geopolitical where they are already mobilized, and which they have comparative advantage in terms of logistic and community social relations.
No bidders should submit bid for more than one (1) lot.
ii). Category   c: roads and bridges

  1. Annual turnover average turnover of two hundred and fifty million naira (250,000,000.00) (as stated in a veritable tax clearance certificate) in the last three (3) years (2014, 2015 & 2016);
  2. Bidders’ Experience
Experience as a contractor on at least one (1) project of similar nature and complexity comparable to the works under consideration within the last five (5) years (Copies of letters of award/ certificates of completion to be attached);
  1. Plant and Equipment
Evidence that the bidders have the requisite plants and equipment to execute plants and equipment to execute project of this nature and complexity;
  1. Financial capability
Evidence of access to or availability of credit facilities, certified by the bankers, equivalent of one hundred (100) million naira minimum amount of liquid assets net of other contractual commitments of the successful bidders shall be required;
  1. Manpower
Company profiles with CVs of key professionals including photocopies of relevant academic and professional qualifications with attestation of availability and contact phone number (evidence of registration with relevant regulatory professional bodies e.g. COREN, ARCON, CORBON, and QSRBN);
  1. Please note that indigenous companies have an advantage in this category.
  2. Maximum number of lots
Bidders must restrict their submission of bids to maximum of one (1) lot located in a geopolitical zone where they are already mobilized.
No bidder should submit bid for more than one (1) lot.
iii). Category   c: bridge
Technical requirements:
The following are additional technical requirement for bridge: to be eligible for prequalification, the bidder must be suitable experience specialist in concrete repair works and bridge rehabilitation and shall have the following minimum criteria:
  1. Evidence of experience related to the project’s scope of works which must be described in details, namely changing of expansion joints, concrete strengthening, changing of bearings post tensioning works concrete skin repair, pavement rehabilitation, corrosion protection measure, etc
  2. Submit method statement and provider repair techniques related to concrete repair works in which must comply with the entire necessary technical requirement and must be properly coordinated with other refurbishment works of the bridge.
  3. Applicant must have been engaged in active business as a concrete repair work and bridge rehabilitation contractor for a minimum of two jobs under the name of the firm applying for prequalification and must be provide a word letter as evidence.
  4. Applicant must provide all information pertaining to the experience of the firm and to it specialist engineers in similar type of works (provide CVs).
  5. Evidence of having access to a specialized bridge repair material and bridge component’s manufactures and suppliers.
  6. Capability of batching, controlling placing finishing and curing concrete with specialized material for the resurfacing of the burnt section of the bridge deck.
  7. Evidence of having local experience in the same type of works within the last few years is an advantage.
No bidder should submit bid for more than one(1) lot

5.0   method of submission:
  1. Prequalification document for construction and rehabilitation of road (category A, C& other projects) must be submitted on or before 12 noon Monday, 18th December, 2017. Any submission made thereafter stand rejected.
6.0   opening bids: 
  1. Submitted document are to be opening immediately after closing of submission of bids on:
  2. Monday 18th December, 2017 for construction and rehabilitation of road/bridges (category A, C & other projects).
 The opening will commence by 12 noon immediately after closing of submission on Monday 18thDecember, 2017 at the ministry’s conference room;
  1. Only technical shortlisted bidders will be invited to witness the opening of their financial bids and;
  • Companies or their representatives, civil societies, NGOs, professional bodies and member of the general public are invited to witness the bids opening exercise through this medium.
7.0     Additional information:
Please note that:
  1. The ministry may verify any or all the claims made by applicant and shall disqualify any company whose claims are found to be false in addition to other sanction that may be deemed necessary;
  2. Bidders who have worked for the ministry and have history of poor performance, abandonment, termination and/or prolonged contract execution period need not apply;
  • This advertisement shall not entitle prequalified companies to make any claims whatsoever, and/ or seek any indemnity from the ministry by virtue of such companies having been prequalified
  1. The ministry reserves the right to reject any and/or all prequalified bidders at its sole discretion and at no costs whatsoever;
  2. All costs incurred in responding to this advert and prequalified for the project shall be borne solely by the bidders;
  3. Submission must be accompanied with a sworn affidavit indicating that all documents submitted are genius and verifiable;
  • Two (2) hard copies and one (1) soft copy of profiles are to be submitted for each lot applied for;
  • For bidders bidding for projects in the Niger delta area and the north eastern geopolitical zone, it is require that they present a formal undertaking that they are capable of working in the area.
  1. Non compliance to the instructions will leads to disqualified; and
  2. This advertisement shall not be construed as a commitment on the part of the ministry to a award contract to any bidders
